Uptick in realty sector, but still in turmoil

Despite an uptick in the real estate sector last month, the recently introduced Land Use Regulation 2022, along with liquidity crunch continues to pose challenges for the realty market, with the number of transactions slumping by nearly 60 per cent.

According to the records of the Department of Land Management and Archive (DoLMA), altogether 29,184 houses and plots of land were bought and sold across the country in a one-month period between mid-November and mid-December this year.

As per the department, the total number of properties sold stood at 69,412 in the same period of previous fiscal 2021-22, which clearly paints a gloomy picture of the property business of the country.

According to Bidhur Dhamala, acting president of the Nepal Land and Housing Developers Association (NLHDA), the government's new rules regarding land utilisation has exacerbated the challenges facing the realty sector, which had been struggling due to Nepal Rastra Bank (NRB)'s strict policy.

"Even as the commercial banks have tightened loan disbursement to the realty sector due to liquidity crunch, the realty business had started witnessing a gradual uptick.

But introduction of the government's new policy has resulted in the business coming to an almost standstill," Dhamala told The Himalayan Times.

According to him, despite the good intentions behind introducing the regulation for systematic urbanisation, it is irrelevant for a developing country like Nepal.

"With the inadequate budget and manpower, it is a daunting task for the local government to classify the land as agricultural or non-agricultural," he added.

As per the new regulations, land has to be categorised as agricultural, residential, commercial, industrial, area of mines and minerals, forest, public use, area of cultural and archaeological importance, and others based on topographicalfeatures, efficiency and utility of land, its existing use and necessity.

The regulations prohibit the commercial land plotting and its sale in areas except in classified areas for residential purposes.

Dhamala further stated that the banks' high interest rates have also discouraged the people from investing in real estate.

"People that are planning to buy properties have put their decision on hold and have deposited their money in the banks because it is a safer investment and the returns are also good at present," he added.

Although the number of properties traded decreased in the review period compared to the corresponding period of last year, it went up by 1,245 compared to the earlier month (mid-October to mid-November), when 27, 939 properties (houses and land) were sold across the country.

However, the revenue generated from real estate business decelerated in the review period.

According to the department, the government collected revenue worth Rs 2.64 billion from real estate transactions in the review month, a fall of Rs 358 million compared to the previous month, when revenue worth Rs 3.01 billion had been generated from real estate business.

Meanwhile, the property sales in the Kathmandu valley also slightly improved in the review month.

According to the data of the Land Revenue Department, nine Land Revenue Offices in the three districts of the valley reported sales of 3,195 properties compared to 2,779 properties in between mid-October and mid-November.

As per the department, the highest number of property sales was from the Land Revenue Office (LRO) Lagankhel, with 715 land and houses bought and sold.

Likewise, 565 land and houses were sold and bought from LRO Bhaktapur, 553 from LRO Kalanaki, 424 from LRO Sankhu, 349 from LRO Chabahil, 281 from LRO Manamaiju, 146 from LRO Dilli Bazaar, 155 from LRO Tokha and 7 from LRO Gotikhel, respectively.

Nepal self-reliant in grill and steel business

BHAKTAPUR, July 31: While Nepal is increasingly becoming dependent on other countries for a majority of commodities, it remains self-reliant in the grill and steel business. Businessmen have said that if it is given more emphasis, export to foreign countries could also be probable soon.

Mohan Katuwal, president of the Federation of Grill & Steel Fabricators Nepal, said that Nepal is almost self-sufficient in the grill and steel sector. He said that there would be no problem in exporting the products if the government helps. “Until a few years ago, Nepal was dependent on grills and steel. There was a situation where we had to import them from India and China,” he said. “But now, we are almost self-sufficient and with some effort, we can also export them to various countries,” he added.

According to the statistics, there are more than 11,000 industrial units in the grill and steel sector across the country. Those industrial units have been providing direct employment to 160,000 people by teaching skills to 3,000 youths annually. Works related to metal fabrication worth Rs 65 billion are being done each year.

“There is still a shortage of skilled manpower in this industry,” President Katuwal adds. “Additionally, we have helped prevent many young people from going abroad by giving them jobs in this sector.” He also stated that due to the lack of skilled manpower, the federation has also been involved in providing various training. It accuses the government of not paying attention to the problems in the sector even though there is potential for good business. Since there is a mountain of problems in the grill and steel business, the businessmen have demanded that the government address those problems.

Niranjan Kumar Shrestha, senior vice president of the federation, said that the businessmen are disappointed because the government has not given much consideration to the protection of the sector. They said that they are also doing social work such as making temporary iron houses for the people who have been reduced to living under the open sky after the devastating earthquake of 2015 and providing relief materials to the flood victims.

In recent times, the use of iron has increased among consumers as an alternative to wood. According to the stakeholders, this has stopped the destruction of forests, helped to maintain environmental balance by aiding in the growth of the forest cover, and also helped to reduce floods and landslides caused by soil erosion.

Property right sought for Nepali diaspora

Newly-elected President of Association of Nepali Teraian in America Mridula Gupta said the Nepali diaspora should be given rights to acquire and dispose property in Nepal on par with Nepali citizens.

Talking to THT, Gupta said there should be no hurdle for Nepali diaspora to transfer their property and benefits earned through investments in Nepal to their countries of residence. "At present, a lot of Nepalis who want to invest in Nepal are not doing that because non-resident Nepalis faced hurdles in transferring their profits back to their countries of residence," she said.

There are only a few countries where Nepal can send migrant workers for foreign employment. This means the chances of getting remittances are limited.

Liberalising rules for non-resident Nepalis' investment in Nepal would help Nepal create more jobs and opportunities in Nepal.

Gupta said that her organisation wanted to link the Nepali diaspora to their cultural roots in Nepal by exposing the children of Nepali diaspora abroad so that they could be exposed to their native culture. In order to inculcate Nepali cultural values in the new generations of Nepali diaspora in foreign countries, ANTA is trying to expose the new generation to Nepali culture, language and festivals.

Her organisation is trying to start online classes of languages spoken in Nepal such as Maithili, Bhojpuri, Awadhi and Nepali for children of Nepali diaspora in America and other foreign countries. "Knowledge of language is important to inculcate native culture in children," she said.

She said Teraians have good presence in America and elsewhere and there was the need for linking them with Nepal. She said ANTA was also mulling support for 10 Nepali students, preferably girl children, to attain 10+2 education annually.

ANTA will select 10 students on the basis of merit, keeping in mind their financial situation. ANTA, being a diaspora organisation, is always ready to help Nepal in times of natural disasters as it did during the 2015 Gorkha earthquakes, Gupta said.

She also said during her two-year tenure, she would try to unify the fragmented groups of Madhesi diaspora.

"We are a non-profit organisation, there is no need for Teraian communities abroad to remain fragmented," she argued.

Real Estate Transactions in Nepal : Realty sector recovery stalls

The recovery seen in the realty sector earlier this year seems to be slowing down, with the number of transactions and revenue taking a hit in the recent months.

According to the latest records of the Department of Land Management and Archive, altogether 54,514 houses and plots of land were bought and sold across the country in the one-month period between mid-May and mid-June.

Likewise, a total of 123,652 real estate transactions took place in the review month, an improvement from 98,974 transactions carried out between mid-April and mid-May.

The number of properties traded rose by 13,711 in the review period compared to the previous month (mid-April to mid-May), when 40,803 properties (houses and land) were sold across the country. The local level elections had affected the real estate business that month.

The revenue generated from real estate business also decelerated in the review period. According to the department, the government collected revenue worth Rs 4.24 billion from real estate transactions in the review month, a fall of around Rs 500 million compared to the previous month. Even though the transactions had dropped in between mid-April and mid-May, the government had collected revenue worth Rs 4.78 billion from real estate transactions that month.

The property sales in the Kathmandu valley were also affected in the 11th month of the current fiscal year.

According to the data provided by the Land Revenue Department, nine Land Revenue Offices in the three districts of the valley reported sales of 5,763 properties in the review month against 6,109 properties between mid-May and mid-June As per the department, the highest number of property sales was from the Land Revenue Office (LRO) Lagankhel, with 1,445 land and houses.

Likewise, 1,315 properties were sold and bought from LRO Bhaktapur, 1,024 from LRO Kalanki, 829 from LRO Sankhu, 613 from LRO Chabahil, 273 from LRO Dilli Bazaar, 239 from LRO Tokha and 25 from LRO Gotikhel, respectively.

The business activities in the realty sector had stagnated after the Nepal Rastra Bank (NRB) tightened the provisions for loans to real estate industry citing liquidity crunch in the banking and finance sector. The real estate loans for land acquisition and development attract risk weight of 150 per cent, as per the amendment to the Unified Directive 2021-22 of the NRB.

As per the government data, 70,829 houses and plots of land changed hands in between mid- March and mid-April. Likewise, a total of 74,036 properties (houses and land) were sold across the country in the month between mid-February and mid-March, which was the second highest since the start of this fiscal.

Land Use Regulations 2022 Nepal: Borrowers of BFIs fail to receive loans on land collateral due to mandatory rule of classifying land plots

June 15: Borrowers, who sought to take loans from banks and financial institutions (BFIs) by maintaining land plots as collateral, have been unable to get loans due to the recently-enforced Land Use Regulations 2022.

The BFIs have stopped issuing loans against land collaterals after land revenue offices denied to ‘put on hold’ the transaction of land plots that have been used for securities. According to the new regulations, the land plots cannot be used as securities unless they are classified as agriculture or non-agriculture categories.

The new law has divided land into 10 categories based on their features and geographic situations. The land categories include agricultural, residential, commercial, industrial, mines, forests, public use and cultural-archeological, among others.

Previously, the land revenue offices had been issuing ‘halt transactions’ orders against any land plots that were considered fit for being kept as securities, based on which BFIs would provide loans to their clients. Now, the land revenue offices issue such orders only after the land plots receive the approval of being classified from the local governments.

According to bankers, the dilemma in the procedure to separate types of land plots at the local levels has led to the difficulties in providing loans. The records of Nepal Rastra Bank show out of collateral-based loans provided by the BFIs, about 90 percent use land plots as fixed assets for collaterals.
